    1. Parties

For registry/phone and other contact details, please see the Contact page.

Buyer: The natural or legal person who purchases the service and declares their billing/contact details during checkout. The Buyer's information is recorded in the order and invoice records.

    2. Subject of the Agreement

The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and performance of the digital service (remote desktop/support software subscription or package) ordered electronically by the Buyer through the Polpo Desk website/panel, the characteristics and price of which are stated below.

    3. Service Details and Price

The name and scope of the service (concurrent connections, user/device limits, any add-on connections, duration), the sales price excluding VAT, the applicable VAT amount and the total price including VAT, the currency and any discount information are clearly shown in the order summary and invoice. Prices published on the website and in the panel exclude VAT; VAT is added at checkout at the applicable rate. Prices are those valid at the time of the order.

    • Service type: Digital subscription / package (time-limited right of use).
    • Duration: Monthly or yearly depending on the selected plan.
    • Price: The total amount obtained by adding VAT at the applicable rate to the VAT-exclusive amount shown in the order summary.

    4. Payment

Payment is made according to the method chosen by the Buyer (credit/debit card or bank transfer/EFT). Card payments are collected through the secure infrastructure (3D Secure) of a licensed payment institution; card details are not stored by the Seller. For transfer/EFT, payment is made to the notified account(s) and the service is activated after confirmation.

    5. Performance and Delivery

The service is digital; after payment is confirmed, the subscription/package is performed by being activated in the Buyer's account immediately or within a reasonable time. There is no physical delivery. Performance is deemed completed once the service is made available in the Buyer's account.

    6. Right of Withdrawal

As a rule, the consumer has the right to withdraw within fourteen (14) days in distance contracts. However, this service is digital content/service performed immediately with the Buyer's consent. Since the Buyer, during the order, expressly consents to immediate performance and acknowledges that the right of withdrawal cannot therefore be exercised, the right of withdrawal cannot be used for a service whose performance has begun.

    7. Exceptions to the Right of Withdrawal

Pursuant to Article 15 of the Regulation on Distance Contracts, for contracts relating to intangible goods (digital content/service) performed instantly in electronic environment, the right of withdrawal cannot be used if performance has begun with the consumer's approval. For refund and cancellation terms, please see the Refund and Cancellation Policy.

    8. Buyer's Declarations and Obligations

The Buyer acknowledges that, prior to the order, they have read and understood the essential characteristics of the service, the sales price, the payment and performance information and the provisions of this Agreement regarding the right of withdrawal, and that they have approved them electronically. The Buyer is responsible for the accuracy of the information they declare.

    9. Default and Its Legal Consequences

If the Buyer defaults on card payments, the provisions of the agreement between the cardholder and the bank shall apply. If payment is not made or is refunded/cancelled, the Seller reserves the right to suspend or terminate the service.

    10. Dispute Resolution

For disputes arising from this Agreement, within the monetary limits announced by the Ministry of Trade, the Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence or the Seller's location are competent. The Agreement is governed by the laws of the Republic of Türkiye.

    11. Entry into Force

This Agreement is deemed concluded and in force once the Buyer approves the order electronically. A copy of the Agreement is accessible via the Buyer's account/order records. For questions, you can use our Contact page.
